1. Acceptance of Terms

By downloading, installing, or using Dwindl (the "App"), including its website and all associated services, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing the App.

These Terms constitute a legally binding agreement between you and Nomadan ("Company," "we," "our," or "us").

2. Description of Service

Dwindl is a weight-loss tracking application, available on the Apple App Store, that lets you log your weight, view your trend, and chat with an AI coach. The App operates without traditional user accounts; users are identified by an anonymous device identifier.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice.

3. Not Medical Advice

Dwindl is a tracking and motivation tool, not a medical service. The App and its AI coach do not provide medical advice, diagnosis, or treatment, and should not be relied upon as a substitute for professional healthcare. Always consult a qualified healthcare professional before making decisions about your weight, diet, exercise, or health. You use the App and any guidance it provides at your own discretion and risk.

4. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

5. Subscriptions and Payments

The App offers subscription-based access to premium features ("Dwindl Pro") at $14.99 per month or $24.99 per year. Subscriptions are billed exclusively through Apple's App Store and managed by RevenueCat. All payments are subject to Apple's terms and conditions.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Apple ID settings.
  • Refunds are handled by Apple according to their refund policies.
  • You may restore previous purchases at any time from the App's settings screen.

6. Acceptable Use

You agree to use the App only for its intended personal, non-commercial purpose. You agree not to:

  • Attempt to disrupt, overload, or interfere with the App or its servers
  • Reverse engineer, decompile, or attempt to extract the App's source code
  • Use the App to transmit malware or any harmful code
  • Use the App in any way that violates applicable laws or regulations

7. Intellectual Property

All content, design, graphics, code, and functionality in the App are owned by Nomadan or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App without prior written consent. The weight data you enter remains yours.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NOMADAN EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOMADAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR ACCESSING THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Third-Party Services

The App integrates with third-party services including the Apple App Store, RevenueCat, Google (Gemini, for AI coaching), and Firebase. Each has its own terms and privacy policies.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason including breach of these Terms.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the appropriate jurisdiction.
